Terms & Conditions

Please read these terms and conditions carefully before booking a canoe building workshop. Once payment (deposit or total amount) is received, Kanubau Nord and the client(s) enter into a binding contract based on these terms and conditions. If you have any questions regarding these terms and conditions, please do not hesitate to contact us.

Kanubau Nord means Werner Pfeifer, acting as Kanubau Nord.

1. Agreement

An agreement based on these terms and conditions is concluded when all of the following conditions are met: Receipt by Kanubau Nord of a duly completed booking form together with the payment or deposit specified in this booking form; receipt of the payment or deposit in Kanubau Nord's bank account, and written acceptance by email by Kanubau Nord.

Kanubau Nord reserves the right, at its sole discretion and without giving reasons, to refuse a booking. In this case no contract will be concluded and Kanubau Nord will refund the payment made with the booking form.

The contract is concluded between Kanubau Nord and the Customer(s) and is the only agreement between these parties. Changes in these conditions are valid only if they are agreed in writing with Kanubau Nord before the respective course.

The person signing the booking form is deemed to be the signatory for himself/herself and the representative for all other persons listed on the form, and warrants that he/she has been appointed representative for this purpose.

The agreement is subject to German law.

2. Payments

The amount for the workshop/course is indicated on the Kanubau Nord website. If you have paid the deposit of 100€ (non-refundable), we will hold a place in the workshop for you. The full amount must be paid within 4 weeks before the workshop starts. Kanubau Nord reserves the right to cancel your place if you have not paid the full amount within 4 weeks before the workshop starts.

3. Prices

However, Kanubau Nord reserves the right to change prices if the cost of providing a course increases for reasons beyond Kanubau Nord's control (including, but not limited to, labor, transportation, and material costs).

In the event of a price change, the customer(s) will be notified as soon as possible and the balance of the revised price will be due on the same terms as the original price.

In the event of a price increase of 15% or more, the customer may cancel the booking and will be entitled to a refund of all amounts paid.

4. Cancellations

If the booking is cancelled by the client(s) (for whatever reason) and he/she has paid the full amount, the following cancellation fees will apply:

Cancellation more than 4 weeks prior to the workshop will forfeit the deposit.

Cancellations less than 4 weeks prior to the workshop will incur 100% of the fee.

Deposits are non-refundable.

Customer acknowledges that such penalties are reasonable because Kanubau Nord must make preparations for a workshop well in advance of the start of the course.

Kanubau Nord reserves the right to cancel a workshop up to 4 weeks before the beginning of the course. In case of cancellation on the part of Kanubau Nord, the full amount will be paid to the customer or a new course date will be offered.

5. Modification of a course by Kanubau Nord.

A Kanubau Nord course is inherently subject to natural variables, including weather. Although every reasonable effort is made to deal with (and learn from) such vagaries, Kanubau Nord may be forced, through no fault of its own, to change or modify a course schedule at short notice, or may decide to do so in order to take advantage of natural circumstances. The Customer acknowledges that information about the courses offered by Kanubau Nord is given in good faith, but that it may be appropriate to change or modify a course due to the volatility of nature, and that in such circumstances it is not appropriate for Kanubau Nord to be liable for any loss resulting from such change, and that Kanubau Nord's liability is limited accordingly.

6. The implementation of a course

The Customer acknowledges that during a Kanubau Nord course, the Customer is required to submit to the reasonable direction and management of Kanubau Nord, except that parents, teachers and persons having a comparable role with respect to children must maintain control of such children to the satisfaction of Kanubau Nord. The client acknowledges that persons participating in a Kanubau Nord course are entitled to expect a high standard of conduct and consideration for the personal welfare of all clients. For this reason, the Customer accepts that Kanubau Nord may, at its sole discretion and without giving any reason, exclude him/her from a course if this is done against his/her will. Circumstances in which this may occur include (without limitation) disorderly or abusive behavior, drunkenness, lack of control over children, inappropriate handling of equipment, inability or inability to meet the requirements of the course. In such circumstances, the client is not entitled to a refund and Kanubau Nord is not liable for any resulting losses. The Client will reimburse Kanubau Nord on demand for any reasonable costs that Kanubau Nord may incur as a result.

7. Liability

Kanubau Nord courses take place in a workshop, but also in the great outdoors, on lakes, rivers, estuaries and in agricultural barns, and by their nature are not absolutely risk-free. Kanubau Nord makes every effort to minimize the risk to the customer and instructs the customer in the safe handling of the remaining risk. Consequently, the Client acknowledges that there are circumstances in which an accident may occur through no fault of Kanubau Nord and accepts that to this extent he/she participates in a Kanubau Nord course at his/her own risk.

Kanubau Nord is only liable for bodily injuries of the customer, which can be proved to be caused by the fault of Kanubau Nord.

The Client acknowledges that other losses, damages and costs (including but not limited to loss of money, loss of or damage to clothing and property, losses incurred as a result of cancellation of a booking, and costs of delays and damages not caused by Kanubau Nord's negligence), however incurred, are not the responsibility of Kanubau Nord and that Kanubau Nord's liability is hereby limited.

The Customer further acknowledges that Kanubau Nord, which has negotiated special insurance coverage for its Customers participating in overnight courses, is entitled to expect its Customers to rely on such insurance coverage, if any, and to mitigate any losses accordingly. Consequently, the Customer accepts that it is reasonable for Kanubau Nord to exclude liability for losses for which the Customer is itself insured, and such liability is hereby excluded.

Kanubau Nord assumes no responsibility for the quality and workmanship of the final product. Kanubau Nord supports all phases of construction and assists as needed. However, the responsibility for construction rests with the customer and not with Kanubau Nord.  We do not accept responsibility for injuries caused by the use of tools that have not been shown to the customer.

8. Insurance

Kanubau Nord has negotiated special insurance terms for clients participating in Kanubau Nord overnight courses, and the cost of this insurance is included in the course price. The customer is advised to familiarize himself/herself with the scope of the insurance coverage and to make sure that it meets his/her needs. The Client acknowledges that the information provided to Kanubau Nord is part of the application for insurance coverage for the Client and is aware of the need to fully and openly disclose all matters concerning the insurer.

9. Complaints

In the unlikely event that a customer has reason to complain about a Kanubau Nord course, the complaint should be directed to a Kanubau Nord representative during the event so that corrective action can be taken if necessary. The customer acknowledges that it is inappropriate to do nothing during a course and complain later. However, if a problem cannot be resolved, the complaint must be made in writing within 28 days. To the extent permitted by law, Kanubau Nord will not be liable for complaints reported later than 28 days after the completion of the course in question.

10. Subsequent instruction by the client(s).

Although all Kanubau Nord courses are taught by experienced and capable instructors, it is not intended that any instruction given to a client(s) during a course will in any way qualify such client(s) to instruct third parties, and no warranty is made in this regard. Kanubau Nord hereby disclaims any liability to any third party for any loss or damage suffered by such third party(ies) as a result of their reliance on skills provided to them through participation in a Kanubau Nordcourse.

11. Inability to pay

In the unlikely event that Kanubau Nord becomes insolvent, all monies will be refunded in full.

12. Photography

All pictures on the Kanubau Nord website www.kanubau-nord.de were taken by Kanubau Nord staff, friends or participants in our courses and are the property of Kanubau Nord or the photographer. Permission to use the images on our website was obtained from the photographer and the individual. If we have "accidentally" used a picture of you or by you without your permission, please contact us. If you would like to copy an image and use it on the website, please ask us for permission. You may take pictures for your own use at any time during a Kanubau Nord course.

13. Privacy and data protection

We do not share any information, such as e-mails or names, with third parties. The information we receive about you when you sign up is stored as an email on our email account.  We only store your name, email address, phone number (if you choose to provide it) and possibly your address if you have provided it. If you wish, you only need to provide us with your name and e-mail address for communication purposes.  If you wish to have your information removed from our

e-mail records, or if you wish to inspect correspondence between us and you or internal correspondence, please contact us.

14. Use of the canoe

The use of your canoe is entirely your own responsibility and Kanubau Nord accepts no liability for it.
